New ‘Insurance Coverage Law’ Certification Program Gains Traction

Tallahassee, FL — The Board of Legal Specialization and Education (BLSE) is on the verge of advancing a new “Insurance Coverage Law” board certification program, following revisions requested to meet established standards. During a meeting on November 8, the BLSE approved the concept of the certification but emphasized that further refinements are necessary to comply with Rule 6-3, which governs Florida’s board certification program encompassing 27 practice areas.

Final approval from the BLSE is expected at their upcoming meeting in January 2024, after which the proposal will undergo scrutiny from Florida Bar committees and ultimately the Board of Governors. A decision will be rendered by the Florida Supreme Court.

The push for this new certification is led by the Real Property, Probate and Trust Law Section, which highlights a critical gap in the legal landscape concerning insurance law, particularly following the devastation of three major hurricanes in the past year. Tampa-based insurance attorney Debby Crockett notes that the need for certified legal support is crucial for homeowners facing challenges with denied or insufficient insurance coverage.

"As Florida consumers grapple with insurance claims, it is essential they can connect with experienced board-certified attorneys prepared to advocate for their rights,” Crockett stated. Her panel, which spent months consulting various Bar sections and gathering support, counts over 258 attorneys ready to pursue certification once the program is implemented.

The initiative has received endorsements from consumer advocacy group United Policy Holders, the Florida Justice Association’s Property Insurance Section, and the Defense Lawyers Association, showcasing its widespread appeal and importance in helping Florida residents navigate insurance challenges amid natural disasters.
