Florida homeowner seeks class action lawsuit against insurance company after being featured on ’60 Minutes’


The aftermath of Hurricane Ian in 2022 left Virginia and Jeff Rapkin’s North Port home severely damaged. Despite an adjuster’s assessment that they were owed $231,368, their insurance company Heritage Property & Casualty Insurance Co initially claimed they were owed just over $15,000. This led the Rapkins to file a lawsuit, alleging fraud and seeking to turn it into a class action against the company.

Their case, featured on “60 Minutes,” shed light on a broader issue of insurance companies allegedly manipulating assessments to reject or lowball claims. Heritage has faced fines and regulatory scrutiny for its handling of claims post-hurricane, but the allegations of altering adjusters’ reports to pay policyholders less are particularly troubling.

Despite Heritage issuing a check for $372,871, the Rapkins have refused to cash it, holding out for a resolution that doesn’t absolve the company of liability. Their family endured health issues, financial strain, and a loss of their beloved home due to Heritage’s alleged mishandling of their claim.

The Rapkins’ story is not unique, as other adjusters have come forward with similar claims of their reports being altered without their knowledge. State regulators have been aware of this practice since 2019, but have yet to take significant action against the insurance companies involved.

Jeff Rapkin’s refusal to accept Heritage’s check symbolizes a larger battle for accountability and justice in the insurance industry, where policyholders often feel powerless against powerful corporations. As they continue their legal fight, the Rapkins hope to bring attention to the widespread issue of insurance companies allegedly deceiving and mistreating their customers in times of need.
