Bill to remove Florida’s ‘clean hands’ rule for exonerees advances to Senate floor

Legislation that would help Florida exonerees seek compensation for their wrongful imprisonment is making progress in the Senate, with unanimous support in three committee stops. The bill, SB 130, would repeal the “clean hands” rule that currently bars some exonerees from receiving compensation, and would extend the time frame for filing a claim to two years. Since 1989, 91 people in Florida have had their convictions overturned, but only five have received compensation. The bill would not change the $50,000 per year compensation amount for exonerees, with one person potentially receiving $1.7 million. The bill has received support from various organizations and is on track to be passed in both chambers, with a projected cost of $15 million for the state. HB 59, the House twin bill, is also moving forward with no negative votes so far. This legislation aims to provide fair and equitable compensation to those who have been wrongfully imprisoned in the state of Florida.
